Keep in mind that Frode.ai is a digital conversation partner that is largely based on artificial intelligence, without the involvement of humans in the individual conversation. Frode.ai can make mistakes. You are responsible for assessing the quality and consequences of what Frode.ai communicates to you. Frode.ai does not offer health care or psychological assistance, and if you need such assistance, you must contact qualified personnel. You must be at least 18 years old to use Frode.ai. Please read this document before using Frode.ai.

  1. Introduction 

Frode.ai is provided by the Norwegian company The We Effect AS (also referred to as "we" and "us"). In this document, you as a user of the service (referred to as "user" or "you") will find information about how the service works, what is legal and illegal when using the service and our and your responsibilities. 

It is therefore important that you read this document, which in the following we call the "Agreement". When you start using Frode.ai, we consider the Agreement to be accepted by you.

All questions related to the Agreement, our processing of your personal data or your use of Frode.ai can be directed to hi@frode.ai.

  1. The service

Frode.ai is a digital conversation partner, largely based on artificial intelligence ("AI") and the use of generative language models. The purpose of Frode.ai is to offer an empathetic conversation partner. Frode.ai is under development and we may continuously make changes to Frode.ai and add or remove features. We also refer to Frode.ai in the following as the "Service".

The aim of the Service is to show understanding and ask relevant questions related to family life, relationships, social relationships and coping in everyday life. No humans are directly involved in the individual conversation. Since the Service is based on AI and is under development, it may contain errors and omissions. See more about this below.

Our goal is for the Service to be available 24/7, but we cannot guarantee that there will be no downtime or instability. Access to the Service requires that you have the necessary login credentials, an active subscription, internet access and a compatible device (e.g. a supported smartphone). 

The Service can only be used by personal users for their own private use.

  1. Price and payment

3.1 In general 

The Service may either be paid for by you, your employer/affiliated company/organization or offered to you free of charge. If you are using a free version, we may at a later date introduce payment for the use of the Service. In that case, you will be notified and given the opportunity to terminate your use of the Service before payment is introduced.

3.2 For those who purchase access to the Service directly from us

You can purchase access to the Service directly from us. Purchases and payments are made via the App Store or Google Play Store. Handling of your payment information (e.g. card number) is done by Apple/Google, and we do not have access to such information.

The prices and purchase options for the Service applicable at any given time can be found in the App Store and Google Play Store. If you have chosen to purchase a subscription to the Service, payment will be made continuously until you cancel the subscription. Termination takes place through the App Store and Google Play Store. Upon termination, you will have access to the Service until the next payment date.

3.3 For those who access the Service via their employer or others

We have partners (employers, suppliers, organizations, etc.) who may purchase access to the Service and share this access with employees, customers or others. If you gain access to the Service in this way, you will receive an access code to be entered into the Service. Use of the access code will give you access to the Service in accordance with our agreement with the relevant partner.

  1. User account, age limit and access to the Service

You must create a user account to access the Service. To use Frode.ai, you must be at least 18 years old.

Your user account is personal and should only be used by you. You are not allowed to share your login information to the Service with others.

We reserve the right to restrict access to the Service in order to control the roll-out of the Service. The Service will gradually become available to more users and in more geographical areas. Your access to Frode.ai is dependent on the fact that we allow new users to use Frode.ai and that you are one of these.

  1. The content of the conversation

What you write in the conversation with Frode.ai, or otherwise share of information with Frode.ai, constitutes data that is recorded and processed to provide you with a response. The information you provide to the Service is referred to as "Input" and the response generated by Frode.ai based on your Input is referred to as "Output". Frode.ai may also prepare and store its own notes, not visible to you, and this is referred to as "Notes". Input, Output and Notes constitute the content of the conversation and are referred to as "Content".

  1. Use of Content for quality assurance and development of Frode.ai

All or part of the Content may be stored so that you can resume your conversation with Frode.ai at a later date. The Content will be linked to your user account and may include information about personal matters. The Content will depend on what Input you choose to share with the Service.

We will not use the Content for training of our models unless we have received explicit consent from you. You can also actively choose to share the Content with our support service if there are conditions in the conversation with Frode.ai that you want us to be aware of.

  1. Proper use of the Service and your responsibilities

It is in the nature of AI and generative language models that there is an inherent risk of hallucination or otherwise unreasonable, erroneous, uncontrolled or inappropriate behavior. This means that although the Service is developed with the aim of providing qualified answers, it may produce answers that are not correct or true, or that do not constitute reasonable or correct advice in the relevant context. You must always evaluate the quality of the answers you receive. If you find that the Service is not performing as expected, please report this to us.The Service, including the Content, may contain inaccuracies, factual, typographical or linguistic errors and other errors. You understand that you use any information available on the Service at your own risk and that the Output is not quality assured by us or subject to any form of human control.

 

The Service is intended to serve as a general conversation partner and is not a substitute for consultation with healthcare professionals or other professional advisors. If you are in need of health care or psychological or therapeutic assistance, you should contact qualified human personnel. 

You understand and acknowledge that we cannot guarantee or be held liable for the Content or for the result of the conversation or your use of the Service other than our obligation to provide the Service as described in the Agreement.

  1. Use of third-party providers

We will use various third-party suppliers where we find it relevant in order to develop and operate the Service. The Service is largely based on the use of AI, including generative language models, provided by third-party suppliers.

We are free to change third-party suppliers. Where relevant, we have entered into data processing agreements with our third-party suppliers. You can also find relevant information in our Privacy policy.

  1. Input to the Service

You are welcome to contribute ideas, change requests and other input regarding the Service. If you provide us with such input, you grant us a royalty-free license to use, modify, share and commercially exploit such input or the result of such input (in whole or in part) in any form, on any medium, or using any technology, now known or later developed, for any purpose we see fit. Upon public display, identifying information shall be removed.

As long as you have access to the Service, you accept that we may contact you by email with an invitation to provide input as described in the previous section. The purpose is to ensure that the Service is delivered as agreed, and to help us identify errors, omissions or areas for improvement. If you no longer wish to receive such emails, please contact us and request deletion of your user account.

 

  1. About the processing of personal data 

The We Effect AS is responsible for processing your personal data in the Service in accordance with applicable privacy regulations.

 

If you have accessed the Service through one of our partners, we are potentially a "joint controller" with them. This means that our partner is responsible for handing over your contact information to us, while we are responsible for the Service itself. We assume that our partners have a valid consent or other legal basis for sharing your contact information with us. If you do not want our partners to disclose your contact information, you can contact them. If you wish to exercise your rights in other ways, you can contact us directly.

  1. Right of withdrawal

When delivering digital Services, citizens of the EU/EEA normally have a right of withdrawal under consumer rights legislation. However, when you start using the Service, you get immediate access to digital content. This means that you will not have a right of withdrawal and that you have acknowledged at the start of the Service that the right of withdrawal has been lost.

  1. Confidentiality 

All our employees have a duty of confidentiality and all information that can be linked to individuals that we become aware of through the development and operation of the Service will be treated confidentially.

Information you become aware of in connection with the use of Frode.ai shall be treated confidentially. This includes, but is not limited to, the Content, information related to the technological solution and third-party suppliers we use. Confidential information shall not be disclosed to third parties without our prior written consent. This confidentiality obligation shall last as long as you have access to the Service and for five years after your use of the Service has ended.

You are allowed to discuss your use of Frode.ai with others, but you are not allowed to share Content from the Service with others. This means, for example, that you may not post screenshots online or otherwise share confidential information.

  1. Safety and security

The conversation between you and Frode.ai is encrypted. In addition to creating a password for your user account, you must create a separate password used for encryption of the Content.

All personal data related to the Service is stored in cloud solutions with third-party providers and is protected with relevant security measures.

  1. Intellectual property rights

The We Effect AS, or whoever we later choose, owns and retains all rights to the Service and to the Content. This includes, but is not limited to, the concept, trademarks, designs, know-how, trade secrets, copyrights and all other intellectual property rights. All rights that may arise in connection with the provision of the Service belong to us. This includes any right of subcontracting.

The Agreement does not entail any transfer of rights to you as a user other than giving you a non-exclusive, temporary and revocable right to use the Service in accordance with the Agreement during the agreement period.

  1. Illegal use of the Service 

You may not use the Service in a way that is contrary to the Agreement or any law, regulation or order from public authorities. You may not share information with the Service (e.g. information about other persons) that you do not have valid consent to share.

It is not permitted to discuss, or attempt to get the Service to discuss, topics that relate to health care, contravene general social morals or topics that breaches applicable laws and regulations. For example, it is not permitted to discuss or attempt to get the Service to discuss topics such as suicide, suicide attempts, abusive behavior, violence, etc.

It is not permitted to change, modify, copy, reproduce or imitate the software that forms the basis of the Service or other parts of the Service. You may not attempt to gain access to information, or parts of the Service or data in the Service for which you are not authorized. You may not use any tools or methods, or otherwise attempt to acquire information, access or otherwise exploit the Service.

Any behavior and use of the Service that you should reasonably understand may be detrimental to the Service, other users, third parties and/or The We Effect AS is prohibited.

We reserve the right to terminate access to the Service if we detect use in violation of these terms.

  1. Complaints, compensation and limitation of damages

We have a duty to provide the Service in accordance with the Agreement. If you believe we have not fulfilled the Agreement or have other questions or suggestions, you can contact us at the contact information stated at the end of the Agreement. We handle complaints in accordance with mandatory legislation.

The parties' liability is limited to the amount you have paid for the Service, insofar as this is in line with mandatory legislation. You cannot claim compensation for indirect losses, including but not limited to loss of profit, loss of use, loss of data and claims from third parties. Nor can you claim damages for your reliance on or use of Output from the Service.

  1. Term, termination, amendment and assignment of the Agreement

The Agreement runs until it is terminated by one of the parties.

The Agreement may be terminated at any time by either party. Upon termination, you no longer have the right to use the Service beyond any prepaid period. We will normally terminate the Agreement if you have not used the Service for a period of 12 months.

We can change the Agreement with 14 days' notice. If you do not accept the changes, you may withdraw from the Agreement with effect from the time the change comes into force. If you continue to use the Service after the change has entered into force, the change is considered accepted.

You may not assign the Agreement to a third party without our written consent. We may assign the Agreement, provided that the content of the Agreement is not materially changed, without your consent.

  1. Choice of law and dispute resolution

This Agreement is governed by Norwegian law. The parties agree to Oslo District Court as the venue for disputes that cannot be resolved amicably. If you are a consumer under EU/EEA law, you may be entitled to venue at your home court.

If you are a citizen of the EU/EEA, you can use the complaint body available at ec.europa.eu/consumers/odr. This applies until March 2025. You may have the right to use a complaint body in your country, such as complaining to Forbrukerklagetvistutvalget in Norway.
